Há quase quinze dias propus a constituição do Tribunal Ético Internacional (TEI) do Fórum Social Mundial (FSM). A ideia seria criar uma instituição permanente do Conselho Internacional (CI) do FSM cuja primeira sessão teria por objetivo julgar jurídica e politicamente o golpe parlamentar em curso no Brasil.

Concebi-o como um grande tribunal de opinião, cujos juízes seriam personalidades mundialmente conhecidas e respeitadas e que reuniria em Brasília durante o período em que está a ser julgado o impeachment da Presidente Dilma Rousseff. O objetivo era criar um julgamento paralelo ao do Senado brasileiro e assim contribuir para a deslegitimação internacional deste grave atropelo à democracia num país-chave na emergência dos BRICS (articulação entre Brasil, Rússia, Índia, China e África do Sul).
Os BRICS foram uma iniciativa destinada a promover a multipolaridade nas relações internacionais, um dos grandes objetivos do FSM desde o seu início. O projeto dos BRICS está hoje agonizando com a neutralização da Rússia, o isolamento da China, a cooptação da Índia e a desestabilização do Brasil. A partir de então o TEI-FSM poderia ser ativado
noutras situações julgadas importantes pelo CI.
Esta proposta assentava em duas condições:
1-Reunir durante o julgamento do impeachment, ou seja, enquanto faz sentido fazer pressão internacional. Para isso teria provavelmente de reunir antes do FSM de Montreal. Isto implicaria que a decisão do CI fosse obtida por via eletrónica.
2-Uma vez que o Tribunal se reuniria no Brasil, teria de contar com a participação ativa das organizações brasileiras que integram o CI, não só por razões logísticas, mas também por uma questão de princípio pois doutro modo correríamos o risco de cometer um ato de intervencionismo arrogante de que o mundo está infelizmente cheio.
Depois de fazer a proposta esperei quase quinze dias pelas possíveis reações das organizações integrantes do FSM. Foram poucas as reações, umas a favor outras contra a proposta. Mas o silêncio mais esclarecedor foi o das organizações brasileiras sem cujo envolvimento não seria possível reunir o TEI-FSM. Apenas o Ibase se manifestou, através do seu diretor, Candido Grzybowski, um dos principais animadores do FSM nos primeiros anos, numa mensagem em que apoiava a iniciativa e em que, ao mesmo tempo, me advertia que, devido à imobilidade a que o CI se fora submetendo, a minha proposta não teria qualquer viabilidade.
Perante o silêncio das organizações brasileiras, sou obrigado a concluir que a minha proposta não tem viabilidade. Aliás, ao que consta, a decisão do Senado sobre o impeachment pode correr até 31 de Julho e assim sendo, o TEI-FSM teria de reunir no prazo máximo de um mês e meio. Seria preciso muito envolvimento e muito entusiasmo local e internacional para que tal fosse possível. Claro que o tribunal poderia reunir em Brasília mesmo depois (não muito depois) do fim do processo do impeachment, se este se concretizar, o que é mais do que provável
Soube entretanto que, por iniciativa de um grupo inspirado na ideia do meu querido amigo e ex-Ministro do governo da Presidente Dilma, Juca Ferreira, se realizará durante o Fórum de Montreal uma sessão auto-organizada sob a forma de um tribunal de opinião sobre o impeachment. É uma iniciativa muito meritória. Todavia, tendo lugar no Fórum e só para o público do Fórum não pode cumprir o objetivo do TEI-FSM.
O fracasso da minha proposta pode não ter sido totalmente inútil. O princípio de que as lutas sociais são, em geral, todas igualmente importantes, não sendo legítimas hierarquias abstratas entre elas, inspirou desde sempre o FSM e continua válido. Mas, ao longo dos anos, foi-se tornando evidente que era necessário distinguir entre lutas importantes e lutas urgentes em contextos específicos e, quanto a estas, pode e deve fazer-se hierarquização sob pena de paralisia ou confusão políticas. Sendo o FSM uma “entidade” de dimensão global, diferentes grupos no seu âmbito em diferentes partes e contextos do mundo podem ativar simultaneamente diferentes lutas urgentes, sem qualquer contradição e sempre com o selo do CI. A incapacidade continuada de fazermos esta distinção está a conduzir o FSM a um beco sem saída. Aliás, no diálogo que mantive com Chico Whitaker foi visível a paralisia e a confusão. Numa das suas mensagens, Chico impacientava-se com o debate sobre o TEI-FSM e a intervenção do CI do FSM no golpe parlamentar em curso porque ele lhe tirava tempo para ir recolher assinaturas contras as usinas nucleares na Avenida Paulista. Sem dúvida, uma manifestação notável de ativismo mas ao mesmo reveladora da patética confusão entre lutas importantes e lutas urgentes. Tal confusão impediu o Chico de pensar que a instalação de um governo ilegítimo, conservador e autoritário não só pode aumentar a probabilidade do recurso à energia nuclear, como pode vir a proibi-lo de recolher assinaturas e a fazê-lo legalmente uma vez aprovadas as leis de criminalização do protesto social.

Almost two weeks ago I proposed the creation of the International Ethical Court of the World Social Forum (IEC-WSF). The idea was to set up a permanent institution of the International Council of the WSF whose first session would have as its main objective to evaluate both in political and legal terms the ongoing parliamentary coup in Brazil. I conceived of the Court as a major tribunal of opinion whose judges would be well known and highly respected personalities worldwide who would meet in Brasília during the period of the judgment of President Dilma Rousseff´s impeachment. The aim was to create a judicial process parallel to that of the Brazilian Senate, thus contributing internationally to delegitimize such a serious assault on democracy in a country that has been crucial to the emergence of the BRICS.
The BRICS were the result of an initiative aimed at promoting multipolarity in international relations, which was actually a major objective of the WSF at its onset. Such an initiative is today expiring due to the neutralization of Russia, the isolation of China, the cooptation of India, and the destabilization of Brazil. From then on the IEC-WSF could be activated in any other situations deemed important by the IC.
The proposal was based on two conditions:
1-That the Court meet during the judgment of the impeachment, that is to say, while it makes sense to use international pressure. Thus, it would probably have to meet before the WSF Montreal, which would imply getting the decision of the IC prior to that by internet.
2-Since the Court was to meet in Brazil, the Court would have to count on the active participation of the Brazilian institutions that integrate the IC, not only for logistic reasons but also as a question of principle. Otherwise, we would be running the risk of committing an act of arrogant interventionism of the kind of which the world is sadly full.
After I made the proposal, I waited almost two weeks for possible responses from the organizations that are part of the WSF. The responses were few, some in favor, some against. The most eloquent silence, however, was that of the Brazilian organizations without whichit would not be possible to have the IEC-WSF meet. Ibase alone responded, through its Director, Candido Grzybowski, one of the mainactivists of the WSF in the first years, in a message supporting my initiative and at the same time warning me that, due to the self-inflicted immobility of the IC, my proposal would not be viable at all.
Confronted with the silence of the Brazilian organizations, I am compelled to conclude that my proposal is indeed not viable. It seems that the Senate?s decision about the impeachment can take as long as until 31 July, in which case the IEC-WSF would have to meet in the next month and a half. Only a lot of local and international involvement would make it possible. Obviously, the Tribunal could meet in Brasilia even after the end of the impeachment process (not long after, though) in the case that the impeachment is definitively declared, the most probable result.
I have heard meanwhile that, by suggestion of a group inspired by a dear friend, the former minister of President Dilma, Juca Ferreira, a self-organized session will take place during the WSF-Montreal to discuss the impeachment. This is a very worthwhile initiative. However, as part of the WSF and addressing only the WSF audience, it will not fulfillthe objective of the IEC-WSF.
The failure of my proposal may not have been totally in vain. The principle according to which all social struggles are, in general, equally important, no abstract hierarchies among them being legitimate, has inspired the WSF since its beginning and is still valid. In the course of years, however, the need to distinguish between important struggles and urgent struggles in specific contexts has become obvious. Regarding the latter hierarchization is in order, lest political paralysis or confusion ensue. Since the WSF is an ?entity? of global scope, different groups inside it in different parts and contexts of the world may activate different, urgent struggles at the same time without any contradiction whatsoever and always with the seal of the IC. Our continued incapacity to make such a distinction is leading the WSF to a dead-end. Actually, in my dialogue with Chico Whitaker the paralysis and confusion were quite visible. In one of his messages Chico showed impatience with the debate on the IEC-WSF and the intervention of the IC of WSF in the ongoing parliamentary coup because he was feeling robbed of the time he needed to collect signatures against the nuclear plants in Avenida Paulista. Without any doubt this is a remarkable exercise of activism but at the same time is revealing of a pathetic confusion between important struggles and urgent struggles. Such confusion prevented Chico from realizing that an authoritarian, conservative, and illegitimate government may not only increase the probability of recourse to nuclear energy, but also
eventually forbid him legally from collecting signatures once further laws criminalizing social protest get approved.
